These Terms and Conditions ("Terms") govern access to and use of the Tendon platform, including its website, mobile applications, and related services (collectively, the "Platform").

Tendon is a brand operated by Orzuv Fitness ("Tendon", "we", "us", or "our"). By accessing or using the Platform, you agree to be bound by these Terms.

1. Definitions

• "Platform" refers to the Tendon website, mobile applications, and related digital services.

• "Providers" refers to verified fitness trainers, coaches, and professionals offering in-person fitness services through the Platform.

• "Consumers" refers to individuals or business entities (including gyms, studios, clubs, schools, or organisations) that use the Platform to discover, engage, or hire Providers.

• "Services" refers to fitness, training, coaching, or related services offered by Providers.

• "Subscription" refers to a paid plan required to access certain Platform features.

2. Platform Role & Scope

Tendon operates as a commission-free discovery and connection platform that enables Consumers and Providers to connect for in-person fitness services.

• Tendon does not provide fitness services directly.

• Tendon does not act as an employer, agent, or representative of Providers.

• All service engagements occur directly between Consumers and Providers.

3. Eligibility & Account Registration

• Users must provide accurate, current, and complete information during registration.

• Providers must submit valid identity, certification, and professional details for verification.

• Tendon reserves the right to approve, reject, or suspend accounts at its discretion.

4. Verification & Trust

Tendon undertakes reasonable efforts to verify:

• Provider identity

• Professional certifications

• Experience and credentials

Verification confirms authenticity but does not guarantee service outcomes or quality.

5. Subscriptions & Access

Providers

• Providers may access the Platform through a freemium or trial period.

• An active subscription is required to continue accessing certain Platform features after the freemium period.

• Without an active subscription, Providers may have limited or no access to Platform benefits.

Business Consumers

• Subscriptions may also apply to business Consumers for access to advanced features or engagement tools.

Subscription details, pricing, and validity are communicated prior to purchase.

6. Pricing, Payments & Fees

• Tendon does not charge commissions on service fees.

• Providers set their own pricing within ranges defined by the Platform.

• Consumers pay Providers directly, without platform involvement.

• Payments may be structured in instalments as defined by the Platform to minimise fraud.

• Tendon is not responsible for payment disputes, delays, refunds, or cancellations.

7. Taxes & Compliance

Providers are solely responsible for:

• Declaring income

• Paying applicable taxes

• Complying with local, state, and national regulations

Tendon does not provide tax or legal advice.

8. Service Delivery & Responsibilities

Providers

• Deliver services professionally and safely

• Maintain valid certifications

• Communicate clearly with Consumers regarding plans, schedules, and expectations

Consumers

• Select Providers independently

• Share accurate health, lifestyle, and fitness history

• Discuss goals openly for effective outcomes

9. Health, Safety & Results Disclaimer

• Fitness activities involve inherent physical exertion.

• Tendon does not supervise or control training sessions.

• Outcomes depend on multiple individual factors.

Tendon does not guarantee results or assume responsibility for injuries, side effects, or unmet goals. Users are encouraged to communicate openly and responsibly throughout their engagement.

10. Reviews & Ratings

• Consumers may submit reviews and ratings based on their experience.

• Reviews are independent and reflect personal opinions.

• Tendon does not control, edit, or influence review content.

• Reviews serve as a reference to help evaluate service quality.

Misuse of reviews or fraudulent activity may result in account action.

11. Fraud, Misuse & Platform Integrity

Users must not:

• Misrepresent identity or credentials

• Engage in fraudulent transactions

• Manipulate reviews or ratings

Reported issues are investigated and may result in temporary suspension or permanent removal.

12. Cancellations, Refunds & Disputes

• Tendon does not manage refunds, cancellations, or disputes.

• All such matters must be resolved directly between Consumers and Providers.

13. Limitation of Liability

Tendon’s role is limited to providing a digital platform for connection.

To the extent permitted by law:

• Tendon is not liable for acts, omissions, or conduct of Providers or Consumers.

• Tendon is not responsible for service outcomes, injuries, or losses arising from engagements.

Nothing in these Terms limits liability where prohibited by applicable law.

14. Suspension & Termination

Tendon may suspend or terminate access if:

• Terms are violated

• Fraudulent activity is detected

• Platform integrity is compromised

Such actions may be temporary or permanent based on severity.

15. Intellectual Property

All Platform content, trademarks, and technology belong to Orzuv Fitness or its licensors and may not be used without permission.

16. Privacy

Use of the Platform is subject to the Tendon Privacy Policy, which explains how personal data is collected, used, and protected.

17. Modifications to Terms

Tendon may update these Terms periodically. Continued use of the Platform constitutes acceptance of updated Terms.

18. Governing Law & Jurisdiction

These Terms are governed by the laws of India. Courts located in India shall have exclusive jurisdiction.
